Tornado Cash Founder's Lawyer Files Motion to Dismiss Case

Tornado Cash founder and developer Roman Storm's lawyer has filed a motion to dismiss the case against him, arguing that the protocol is not illegal and that the prosecution's case is overbroad and violates Storm's Fourth Amendment rights. Storm's lawyer argues that Tornado Cash, a cryptocurrency mixing service, is only abused by criminals, but the protocol itself is not illegal. He also argues that the prosecution's indictment overbroadly interprets the law by stating that Tornado Cash is engaged in the money transmitting business. In addition, Storm's lawyer argues that the court should not have allowed the prosecution to transfer the cryptocurrency in Storm's hardware wallets to government-controlled wallets. The prosecution has admitted that there is no connection between the seized cryptocurrency and the crimes Storm is accused of. Finally, Storm's lawyer argues that the seizure of Storm's hardware wallets by the prosecution violates the Fourth Amendment. He argues that the seizure was unreasonable because the prosecution did not have a warrant and did not have probable cause to believe that Storm had committed a crime. The court has not yet ruled on Storm's motion to dismiss.
